What Is Domestic Violence in Oklahoma?
Even a first offense domestic violence charge can carry serious penalties. Domestic violence crimes in Oklahoma are typically categorized as assault, battery, or assault & battery. What’s the difference between standard assault and domestic violence assault? In a domestic violence scenario, the victim must be:
- A current or previous spouse of the offender
- A current or previous dating partner
- Someone with whom the offender has a child
- A family member (by blood or marriage) of the offender
- A foster parent of the offender
- Someone with whom the offender lives or lived with
- A spouse of the offender’s former spouse
Domestic violence assault is the threat of or intended physical harm to a person meeting the above criteria. This may include a raised fist or dangerous object. Battery takes place when the offender intentionally harms or causes offense to the victim, such as punching them. If the offender threatens and harms the victim, that would constitute assault and battery.
Domestic Violence Penalties
The penalty for first offense is up to one year in jail and/or a fine of no more than $5,000. This is considered a misdemeanor. However, a subsequent offense constitutes a felony with a penalty of up to four years in prison and/or a fine up to $5,000.
These are just the basic fines and penalties for domestic violence. Several other factors could increase fines and prison time drastically. For example, if domestic violence occurring in the presence of a child can mean up to five years in prison and/or a $7,000 fine. If the offender shoots the victim with a firearm, they could face charges of life in prison.
